SC allows TNCA polls to be held on Sep 28; Coa protests

NEW DELHI: The Supreme Court on Friday allowed the Tamil Nadu Cricket Association to hold elections to elect its office bearers on September 28. The apex court observed that the state cricket body has not fully adopted the new constitution of the Board of Control for Cricket in India (BCCI), but it can certainly hold elections.

The top court also said that the Tamil Nadu cricket body’s election results shall be subject to its final orders.

On its part, the Committee of Administrators (CoA) objected to the move, pointing out the association was unwilling to comply with or ratify the terms of the new BCCI constitution as ordered by the apex court and asserting it would set a wrong precedent.

Amicus curiae and senior advocate PS Narasimha submitted only three member associations had not complied with the new constitution and the TNCA was one of them.

“They must comply with the constitution,” The Hindu quotes Narasimha as stressing.

“They can do whatever they want to… point is they are indeed holding elections. We can undo the results (of the polls) or even send it to the civil court,” Justice SA Bobde, heading the Bench comprising L Nageswara Rao, orally observed.

Justice Bobde, in the order issued, recorded that all member associations should comply and register their respective constitutions in accordance with the direction of the Supreme Court judgment of August 9, 2018, The Hindu further reports.
